Channel Partner Terms and Conditions Policy

This document outlines the terms and conditions for the Channel Partner Program of Sukunj Buildcon LLP . By enrolling in the program, Channel Partners agree to abide by the terms and conditions set forth below. This agreement forms a binding contract between the Company and the Channel Partner.

1. Definitions

1.1 Company

Sukunj Buildcon LLP, its affiliates, parent, or group companies.

1.2 Channel Partner

The individual or entity enrolling in the Channel Partner Program.

1.3 Leads

Prospective customers willing to engage in construction-related services.

1.4 Program

Sukunj Buildcon LLP’s Channel Partner Program.

2. Enrollment in the Program

2.1 Eligibility
  • The Partner must have experience in marketing, promotion, and lead generation in the construction or real estate sector.
  • Submission of a complete application form, along with required documents, is mandatory.
  • The Partner must not be involved in any legal, economic, or moral violations.
2.2 Application Process
  • Complete all sections of the application form.
  • Provide necessary constitutional and registration documents.
  • Incomplete applications will be rejected.
2.3 Approval
  • The Company retains sole discretion to accept or reject applications.
  • Applicants can retrieve documents within 45 days; thereafter, documents will be destroyed.

3. Responsibilities of the Channel Partner

Any expenses incurred during the construction stage for resource mobilization exceeding the stage-wise fees will be charged on an actual basis. In case of disputes, Sukunj Buildcon LLP’s decision will be final and binding.

3.1 Lead Generation
  • Share verified leads with the Company.
  • Ensure that the leads are genuine and not submitted by multiple Channel Partners.
3.2 Marketing and Promotion
  • Promote the Company’s brand and offerings to leads.
  • Use the Company’s trademarks and logos only with prior written permission.
3.3 Compliance
  • Adhere to the guidelines provided by the Company.
  • Abide by the Real Estate (Regulation and Development) Act, 2016.

4. Commission and Payment

4.1 Commission Model
  • The Company operates on a fixed commission model.
  • The commission structure will be communicated before lead submission.
4.2 Payment Cycle
  • Payments will be processed within 30 days of project commencement.
  • Payments will be made through authorized banking channels in Indian currency.
4.3 Tax Compliance
  • All payments are subject to tax deductions as per applicable laws.

4.4 Refunds
  • In case of project cancellation post-commission payment, the Partner must refund the commission promptly.

5. Intellectual Property Usage

5.1 Designs and Reports
  • The Company grants limited rights to use its trademarks, logos, and other intellectual property for promotional purposes, subject to:
  • Written approval from the Company.
  • Adherence to the Company’s branding guidelines.
  • Unauthorized use of intellectual property will result in termination of the agreement and potential legal action.

6. Representations and Warranties

6.1 The Partner represents that
  • They have the capacity and infrastructure to fulfill their obligations.
  • All information provided is accurate and truthful.
  • The Partner agrees to indemnify the Company against any liabilities arising from the Partner’s actions, including incorrect or incomplete information.

7. Confidentiality

  • All information exchanged during the term of this agreement is confidential and must not be disclosed to third parties without prior written consent from the Company.

8.Termination

8.1 The Company reserves the right to terminate this agreement for:
  • Breach of terms by the Partner.
  • Misrepresentation or submission of fraudulent leads.

9. Dispute Resolution

  • Any disputes arising out of this agreement shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
  • The arbitration will be conducted in Indore, Madhya Pradesh, and proceedings will be in English.

10. Jurisdiction

  • All legal matters arising under this agreement shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.

11. Amendments

  • The Company reserves the right to modify these terms and conditions at any time. Amendments will be communicated to the Partner and will become effective upon acceptance.
