Welcome to Sukunj Buildcon LLP. By accessing or using our services and website, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.
1. Introduction
- These Terms and Conditions outline the rules and regulations for using Sukunj Buildcon LLP’s services and website.
- By accessing our website or engaging with our services, you acknowledge and accept these terms.
- If you disagree with any part of these terms, you may not access our services.
2. Scope of Services
- Sukunj Buildcon LLP specializes in residential construction and related services, including architectural design, project execution, material procurement, and post-construction support.
- Any additional services or modifications to the agreed scope will be provided at an additional cost as determined in a separate agreement.
3. Drawing and Design
- Drawings supplied by us are intended to provide a visual representation of the project and assist with project visualization.
- We strive to confine the design to the client’s dimensions; however, we take no responsibility for final measurements. In exceptional cases, the drawings may not represent the final project.
- Contractors, architects, engineers, suppliers, or tradespeople not part of Sukunj Buildcon LLP’s team must not use these drawings, as they are our intellectual property.
- Clients must ensure that the drawings conform to existing services (e.g., electrical, plumbing, fire fighting, gas) and comply with applicable building regulations.
- If in doubt, clients should seek advice from third-party professionals.
4. Project Pricing and Payments
4.1 Pricing
- All estimates/quotations are valid for 15 days from the date of issuance.
- A deposit of 20% of the total project value secures the quotation and protects against price increases.
- We reserve the right to revise prices unless the deposit has been paid.
- Deposits are non-refundable if the client changes their mind.
- Deposits will be forfeited after 90 days unless extended at Sukunj Buildcon LLP’s sole discretion.
4.2 Payment Terms
- Unless otherwise stated, GST or other applicable taxes are not included in quotes/estimates.
- Payment stages will be outlined in the project agreement and must be adhered to for timely project completion.
- Ownership of goods and services transfers to the client upon receipt of final payment.
- For payments via bank loan disbursal, it is the client’s responsibility to coordinate with the bank to avoid delays.
5. Referral Program
- Eligibility: The referral program is open to individuals registered with Sukunj Buildcon LLP.
- Rewards:
– Referrers receive cashback and exclusive rewards upon the successful conversion of a referred project.
– Rewards include a 25% discount on Modular Kitchen and Furniture vouchers from authorized vendors. - Conditions:
– Rewards are valid after the referee pays 5% of the project value or upon commencement of construction, whichever is earlier.
– A project is considered successfully converted upon completion of the ground-floor slab.
– Cashback is processed within two weeks of project conversion. - General Terms:
– Payments must be made via direct bank transfer.
– Referrals are unlimited annually.
– Sukunj Buildcon LLP reserves the right to amend or terminate the program without prior notice.
6. Client Responsibilities
- Clients must provide accurate information and timely decisions to facilitate project progress.
- Clients are required to verify all materials and services before project execution.
- Clients must not provide instructions directly to contractors or subcontractors to avoid miscommunication and delays.
7. Modifications and Changes
- Changes to specifications, sizes, features, or other project-related instructions will only be accepted in writing (via email or WhatsApp) before the finalization of drawings/designs and the contract.
- Verbal design change requests during project execution will not be entertained to avoid rework and cost escalation.
8. Project Delivery
- Delivery timelines will be finalized at the project’s start and depend on timely client payments.
- Timelines may be altered due to exceptional circumstances such as pandemics, natural disasters, or major festivals. Refunds are not applicable under such conditions.
- No extra cost will be charged for material delivery
9. Warranty and Defect Liability Period (DLP)
- A defect liability period of 18 months is provided for workmanship defects and replacement of faulty fixtures.
- For branded fixtures and fittings, return or exchange policies are governed by the brand’s terms. Clients should refer to individual brand policies.
- The DLP does not cover changes of mind post-installation.
10. Termination
- Either party may terminate the agreement with a written notice of 30 days. Any outstanding payments must be settled before termination.
- Sukunj Buildcon LLP reserves the right to terminate the agreement in case of breach of terms, including non-payment or unethical client behavior.
11. Intellectual Property
- All content, trademarks, and materials provided by Sukunj Buildcon LLP are our intellectual property.
- Unauthorized copying, reproduction, or modification is prohibited without prior written consent.
12. Limitation of Liability
- Sukunj Buildcon LLP is not liable for indirect, incidental, or consequential damages arising from project delays or client decisions.
- Liability is limited to the value of the contract.
13. Amendments
- Sukunj Buildcon LLP reserves the right to update or modify these terms at any time. Updates will be posted on our website.
14. Governing Law
- These Terms and Conditions are governed by Indian laws. Any disputes will be subject to the jurisdiction of the courts in Indore, Madhya Pradesh.
15. Miscellaneous Provisions
a) Modification
- Sukunj Buildcon LLP reserves the right to modify these Terms or add new terms and conditions for the use of the Services. Modifications will be communicated and will take effect immediately unless expressly rejected, which will result in the termination of these Terms.
b) Severability
- If any provision is deemed unlawful or unenforceable, the remaining provisions will continue in effect. Unenforceable parts may be revised or removed to maintain the provision’s intent.
c) Assignment
- Rights, obligations, or covenants under these Terms cannot be transferred or assigned by you without prior written consent from Sukunj Buildcon LLP. We may assign rights to affiliates, subsidiaries, or successors without prior notice.
d) Notices
- Notices and communications (except routine operational ones) must be sent to info@sukunjbuildcon.com. For any questions regarding these Terms, contact us via email.
e) Third-Party Rights
- No third party has the right to enforce any terms herein.
f) Translations
- Sukunj Buildcon LLP will not be responsible for inadequate performance caused by external factors such as natural disasters, terrorism, riots, or other uncontrollable conditions.
g) Force Majeure
- Sukunj Buildcon LLP will not be liable for delays or failure in performance due to unforeseen and uncontrollable events.
h) Entire Agreement
- These Terms represent the entire agreement regarding the Services and supersede any prior communications or understandings between the parties.
i) Waiver
- Waivers of any provision do not constitute ongoing waivers of that or other provisions unless explicitly stated.
